Franklin Power of Attorney Experts

Powers of Attorney are legal documents that authorize someone to make certain decisions on your behalf should you become unable to express yourself. The person you authorize should be a person you trust, such as a family member or friend. In your Power of Attorney document, you will designate this person to make broad or limited decisions for you concerning financial, medical, end-of-life, or other matters. These documents protect you in the event of illness, disability, or incapacity and are often part of a comprehensive estate plan. They provide peace of mind knowing that your wishes will be followed when these decisions become necessary and you are unable to voice your desires. Franklin power of attorney lawyer can help ensure that your document is properly drafted.

Types of Powers of Attorney

Powers of Attorney can be written to become effective immediately, on a certain date, or when you are deemed to be incapacitated. They can also be drafted to end on a certain date or upon your passing. These documents can be designed to be “general” meaning that your designated agent will have the authority to make all decisions concerning the matters you grant, as in a situation where you have been rendered unconscious in an accident or in the final stages of a terminal illness. They can also be specific, such as the power to sign for you in real estate documents or have your taxes done (and sign for you) while you are out of the country.

The areas granted under a Power of Attorney can include matters related to finances, banking, real estate, medical/health care, legal, taxes, business affairs, trusts, insurance, estate, investments, and other life affairs. For example, a medical Power of Attorney can authorize your named person to make decisions for you should an injury or illness render you unconscious.

In general, four types of Powers of Attorney can be made. These include:

  • General Powers of Attorney. These give your agent the power to handle whatever affairs you name, such as those listed above. These powers end should you become incapacitated.
  • Durable Powers of Attorney. These give your agent decision-making authority over whatever affairs you name but remain in effect even should you become incapacitated.
  • Springing Powers of Attorney. These are written to give your agent decision-making power in certain matters when a specific event occurs in your life.
  • Special Powers of Attorney. These give limited power to your named agent who is only allowed to act on your behalf in a specific matter.

Powers of attorney can give you peace of mind knowing that your affairs will be handled according to your wishes when you are unable to be in charge. Without having one in place should you become incapacitated, the court will be required to designate someone for you in a costly legal proceeding.

How Our Power of Attorney Lawyer Can Help You

We can assist you by:

  • Comprehensive Legal Guidance: Creating a power of attorney in Franklin involves several critical decisions. You need to choose a trusted individual (the agent) to act on your behalf and clearly define the scope of their powers. We will guide you through each step, ensuring your POA document accurately reflects your intentions.
  • Customization to Fit Your Needs: Every individual’s situation is unique, so a one-size-fits-all approach does not work with powers of attorney. We will take the time to understand your circumstances and objectives. Whether you need a general POA to manage your finances or a healthcare POA to ensure your medical preferences are honored, we will tailor the document to meet your needs.
  • Ensuring Legal Compliance: A power of attorney must comply with state laws to be valid and enforceable. We ensure your POA document meets all legal requirements and is correctly executed. This includes proper signing, notarization, and, if necessary, document recording. Our attention to detail helps prevent any potential legal challenges or disputes.
  • Updating and Revoking Powers of Attorney: Life circumstances can change, necessitating your power of attorney updates. We can assist you in revising your POA document to reflect new preferences, such as a change in your designated agent or the scope of their authority. If you ever need to revoke a power of attorney, we can guide you through the process to ensure it is legally terminated and that all relevant parties are notified.
  • Addressing Concerns and Questions: Entrusting someone with a power of attorney is a significant decision that often raises many questions and concerns. We are here to provide clear, concise answers and address any issues you may have. We aim to ensure you feel confident and comfortable with your power of attorney arrangements.
  • Protecting Your Interests: A well-drafted power of attorney is vital for protecting your interests in the event of incapacity. It helps avoid the need for a court-appointed guardian, which can be a lengthy and costly process. By choosing an agent you trust and clearly defining their powers, you retain control over your affairs even when you cannot manage them personally.
  • Planning for the Future: Proactive planning with a power of attorney can bring peace of mind to you and your loved ones. It ensures that your financial, legal, and healthcare decisions are made according to your wishes, reducing the burden on your family during difficult times. We will help you create a comprehensive plan that safeguards your interests and provides clarity for your chosen agent.
